Others, though deeply rooted in our expectations, are not as easy to explain theoretically. The right to silence both after arrest and during the trial seems to raise questions of conflict with the need to arrive at the truth. The final category of rights presents perhaps the most basic of all tests of a nation’s human rights record, because the very fact of conviction and punishment means that many, if not most, civil rights are being taken away. The focus here is on the nature of the punishment itself, and is one of the oldest concerns, often revolving around the core prohibition on cruel and unusual punishments .

It is this latter instance where the court has the power to give effect to its decisions, particularly in civil rights cases where the issue for the court is not just to declare the state to be in breach of the law, but to stop it continuing to do so. In the United Kingdom it has even been held that a cabinet minister can be declared in contempt of court where his department, unknown to him, and without intentional malice, ignored a commitment they had made not to deport an asylum seeker until judicial procedures were finished.
